What is a progress-payment invoice on a construction site?
A progress-payment invoice (« situation de travaux ») is an interim invoice issued during the job, billing actual progress rather than waiting for completion. It is standard on long sites: it spares the contractor from funding months of work.
Each one restates the cumulative value of work done since the start, from which everything already invoiced is deducted. Any deposit is then subtracted, followed by the retention.
Retention is capped at 5% of the works value (French law no. 71-584 of 16 July 1971). The client holds it for one year from handover, to cover any defects raised. It is released automatically at the end of that period if nothing was raised. The contractor can obtain immediate payment by providing a bank guarantee for the same amount.

What is the 5% retention?

Is the retention worked out on the net or the gross amount?
The retention applies to the gross amount of each progress claim or deposit. It is deducted from what is payable, not from the VAT owed.
